 Criminal Defense

There are very few things in life that are scarier, lonelier or more stressful than facing a criminal charge.  Every defendant in a criminal proceeding, no matter what the allegation, deserves a strong, intelligent and committed defense attorney. Liz loves to serve as that kind of attorney.  For over five years at the outset of her career, Liz served as the Divide County State's Attorney.  She retired from her role as a prosecutor years ago, after handling thousands of criminal cases over her prosecutorial career. Liz has since enjoyed zealously defending clients in hundreds of criminal cases. Given Liz's former role as a prosecutor and her current role as a defense attorney, she is very familiar with the "ins and outs" of a variety of charges ranging from minor misdemeanors, like DUIs and disorderly conduct, to very serious felonies, including assaults, drug offenses, weapons charges, sexual assaults, burglaries, and the like. Liz has an in-depth knowledge of procedural, technical and constitutional criminal law issues derived from her years of practice in this field.  She has conducted countless criminal hearings at every stage of criminal proceedings, tried and won many complex and difficult criminal trials, and has taken criminal matters successfully even through appeal. Liz understands the gravity, legal and factual complexity, and seriousness of criminal matters -- she can offer you helpful insights and strategy to develop and advance a strong defense.  Liz stands ready to intelligently and vigorously defend your legal rights and interests.

Family Law (Divorce, Parenting Rights/Custody, and Child Support)

Liz has three children and has been married for almost two decades.  Because of her personal experiences on that front, she takes a special interest in family law matters.  Our team appreciates and understands that there  is nothing in life more important than our children, our relationships, our homes, and our personal assets, which we work so hard to maintain.  Sometimes those most crucial parts of life don't turn out the way we plan or hope, and when those changes affect the most critical parts a person's life, a committed, capable and compassionate attorney and support staff is certainly essential.  Liz welcomes clients who are in the midst of family struggles.  We know that divorces and custody matters are emotionally charged and usually exhausting.  We also know that every client and his or her life is absolutely unique. The fact each case is so special requires legal representation with utmost attention, dedication, skill and compassion.  We are here for you.  We pride ourselves on providing the information, support  and representation that  you need to survive these tough challenges -- and come out on the other side stronger person than you were walking in.

Oil, Gas, Wind and Natural Resource Law

Liz arrived and practiced in western North Dakota before "the boom" and has walked hand-in-hand with many clients through the oil play that has since consumed western North Dakota. Liz enjoys and excels in looking out for the interests of landowners, whether that means negotiating or litigating oil and gas leases, surface damage and wellsite issues, pipelining, salt water disposal facilities, mineral-related title/ownership matters, or reclamation concerns. Liz also offers legal counsel and representation in other natural resource fields, to include wind energy. Pendlay Law Office handles a wide array of natural resource related matters on a regular basis and is happy to consult with you about your questions or case. We want to help you to identify and understand your rights and options, which is why we offer individualized consulting and representation services in natural resources law - to help you make an informed decision that is suited specifically to you and your land.

Estate Planning and Estate Adminstration

It is always best to be prepared. Both life and the prospect of death often present difficult, complicated and worrisome circumstances. We understand and we want to help. Pendlay Law Office encourages clients to make sure their power of attorney designations, healthcare directives, wills, trusts and other estate planning tools are in proper order to avoid confusion, conflict, unnecessary worry and heartache for loved ones and so that clients can rest assured that their wishes are carried out as desired before and after death. Pendlay Law Office has an emphasis in estate planning, with a particular concentration in estate planning solutions for farming and ranching clients and clientele with mineral interests. Our estate planning practice does not condone or encourage the "cookie cutter" approach to estate planning, which has become more and more common in this very personalized and important area of legal practice. Whether you are doing your own estate planning or attempting to administer an estate after the death of a loved one, we can appreciate the loss, stress and confusion associated with these types of situations and we are ready to compassionately and competently help you through those times.
